Terms of Service
Last updated: 1 October 2026
These Terms of Service ("Terms") govern your access to and use of Mailbase (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Your account
You must provide accurate information when registering and keep it current. You are responsible for all activity under your account and for keeping your sign-in method secure. Notify us promptly of any unauthorized use.
2. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk email (spam) or messages to recipients who have not consented.
- Distribute malware, phishing content, or deceptive material.
- Violate any applicable anti-spam law, including CAN-SPAM, CASL, or the GDPR/ePrivacy rules.
- Infringe the intellectual property or privacy rights of others.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
You are solely responsible for the content you send and for obtaining valid consent from every recipient on your audiences.
If you use Mailbase's prospecting, you decide whom to contact and why, so you are the controller of that prospecting and Mailbase acts on your instructions; you must send only offers relevant to the recipient's profession and honour every opt-out. The roles and the safeguards are described on the GDPR page.
3. Email sending and deliverability
We provide tools to help you reach inboxes, but we do not guarantee delivery, open rates, or placement. We may pause or limit sending that threatens the deliverability of the shared platform or that generates excessive bounces or spam complaints.
Emails sent through Mailbase's managed sending are delivered through Amazon Web Services (Amazon SES, region eu-west-1, Ireland). Before an email is sent, its content is automatically screened for scams and phishing using a third-party screening service (TypeSafe). A message that the screening cannot clear automatically may be held, and not sent, until a member of our team has reviewed it.
4. Pricing and billing
Mailbase offers a free plan and paid plans shown on the Pricing page. Paid subscriptions renew monthly unless cancelled. If you connect your own sending account (for example your own Amazon SES account), you remain responsible for that account, its delivery costs, and your compliance.
5. Your content
You retain ownership of the campaigns, templates, contacts and other content you upload. You grant us a limited license to process that content solely to operate and improve the Service. We do not sell your data or your contacts.
6. Service availability
We work to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, update features, or discontinue parts of the Service.
7. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates legal or security risk. On termination you may export your data for a reasonable period.
8. Disclaimers and liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Mailbase is not liable for indirect, incidental, or consequential damages. For paid plans, our total liability is limited to the fees you paid to Mailbase during the three months before the event giving rise to the claim, or the maximum extent permitted by applicable law if no fees were paid.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after changes take effect means you accept them.
10. Contact
